Given his previous driving record, and a charge of driving w/o his license, how in the devil did this guy then be determined as to have been driving LEGALLY??? And w/TWO DUIs and one leaving the scene of an accident WHY is he getting off so lightly?

Same reason why folks with dozens of DUIs or those who don't even have a license get on the road...Not enough police to cover all the issues. I'm always amazed the folks get off with such light slaps on the wrists for screwing up. Bring back old 'sparky and put it on pay per view, it would erase the national debt in no time.

Yes, he had more than one job according to the article. And, of course, we have no way of knowing the full story. But, the article did clearly state that he had two DUIs and one leaving the scene of the accident. Those offenses alone should have precluded his driving "legally".
Even if he was at the time of the accident completely reformed and no longer drinking the fact remains that he continued to show poor judgement in getting behind the wheel when he is impaired, whether due to OSA, insufficient sleep due to working too many hours, etc., etc. He continues to be willing to risk the lives of others and THAT is poor judgement and justification for taking him off the road and some true form of punishment.

Way too lenient on this dude. These nebulous associations hurt public perception of legitimate sleep disorders. Those of us with sleep disordered breathing are responsible for our actions. If we're too sleepy to drive, we shouldn't. If we drive inappropriately, we should be held responsible for the outcomes.

I have always dreamed of going to law school -- only trouble my kids tell me that I wouldn't make a good defense attorney cause if I knew they were guilty I couldn't defend them. Did say I would be an awesome prosecutor though. :)
Around here there are the state dui's, then the county and finally the city. All three do not work together to ensure that repeat offenders are off the street. Means that you can get several charges meaning state, county, and city and continue to get slaps on the wrist. Need to make the laws universal -- meaning that it doesn't matter who has jurisdication each entity recognizes the others as far as court records go so that the swinging doors stop.
Hey Walt, I have said that our system could cut its prison population way down if we practiced the eye for an eye justice. If you are proven without a doubt to have done the crime, especially the really heinous crimes -- you should get the same treatment that you did that landed you in hot water.
We had a driver a couple of weeks ago that fell asleep behind the wheel. It was 6 a.m. in the morning. He hit a fertilizer truck head on. The fertilizer truck rolled and caught fire. Driver died, leaving behind a griefing community as he was an upstanding member -- he was a driving force behind volunteer work in his community, a wife and children. The driver that was behind the wheel that caused the accident had numerous prior violations including driving while revoked, multiple DUIs, careless and imprudent, etc. It was decided no charges would be brought against him for this accident. Hummmmm then they wonder why people get upset over these types of accidents.
