Plaintiff's Lawyers Salivating Over Apnea and Trucking Industry

Plaintiffs lawyers haven't yet hit the jackpot with a lawsuit against trucking companies for not testing their drivers for sleep apnea, but they're clearly on the prowl for a test case, as the below indicates:

Ahhh, yes, the "ambulance chasers" of the past have discovered the power of the TV commercial.

And just think, we're going to become a nation of "upholstered roller skates" competing on the highways w/the 18 wheelers.

Does Europe and Asia have as many big 18 wheelers on their highways and autobahns along w/their "upholstered rollerskates" as we do in the states??
It's a hungry world out there for the lawyers. If they smell a dollar, they will try to find it.

While I understand their concept, does it not come back to personal responsibility, ultimately?

Truck drivers, while not all of them, are carrying two or more logbooks to circumvent the DOT regulations and laws. They are trying to travel more distance to get more bucks. The trucking companies are using technology, i.e., satellite tracking and GPS, etc., to try and regulate some of it, but it is like the old saying "a lock only keeps and honest person honest."

Some of the independent truck drivers have no one overseeing their travel with the exception of DOT inspection crews and law enforcement.

When you get behind the wheel of your car, do you realize you have just taken control of a two-ton weapon?

When you are driving along at the speed limit and those 18-wheelers zips past you like you are sitting still, always remember those trucks are 25-30 ton missiles. The operator of that truck may be sleep deprived, under the influence of amphetamines or intoxicated. The use of stimulants by truckers is a very common occurrence.

The lawyers will succeed in their quest, as they are in search of the deep pockets. At what point does personal responsibility play a role. Again, the wrong parties escape and we as citizens’ pay, in higher transportation costs, associated fees and taxes.

Who wins – just the LAWYERS.
