It seems they now tried (unsuccessfully so far) to go after the "deep pockets" (Mercedes): "An accident reconstructionist says new-car smell may have contributed to the accident.
John Koziol of Koziol Forensic investigated the accident, according to court documents.
Erzinger had purchased the car about a month before the accident. Koziol found in his investigation he found that it was emitting new car fumes, court documents said. It might have been a contributing factor, documents said."

I recommend to use the link to review the full article. The sleep apnea diagnosis is framed as dubious at best. I wouldn't be surprised if the accident victim winds up with Central Sleep Apnea as a result of his spinal cord injury, and being a doctor, himself, may subsequently learn about sleep apnea first hand (if anyone figures out to test him for it). If the parties involved ever link to this, maybe some future good could be done toward broader understanding of sleep apnea. Just my wishful thinking!

The defense attorney originally claimed that when his client awoke the bicyclist and bicycle were traveling over the top of the vehicle where they
could not be seen by the defendant. Supposedly the defendant continued driving
not knowing he ever hit anyone.
It would be interesting to know why they claim the defendant then drove 3.3 miles and parked behind an abandoned Pizza Hut.
