From the New York Times ethics column:

 

When my family rents a car, the rental company sends someone to pick us up. The driver they send has sleep apnea (as do I), and he is not getting any treatment. I haven’t seen him drive dangerously, but drivers with sleep apnea are as much as five times more likely to be involved in car accidents. I doubt I can persuade him to get treatment. I am also uncomfortable tattling on him to his employer. What should I do? A. G., MASSACHUSETTS

If someone makes you feel unsafe, don’t get in a car with him. That should settle your nerves. But what would calling the guy’s boss settle?Perhaps the boss would place a gentle hand on the fellow’s shoulder and encourage him to see a doctor. “Don’t worry about the cost,” he might say. “It’s on me.” Then again, he might say: “You’re scaring the customers. Get lost.”Getting him fired — the more likely outcome, I’m afraid — won’t eliminate the problem. It wouldn’t take your driver off the road; it would just make him that much less able to afford the treatment you think he needs.If the law says sleep apnea need not disqualify people from driving, it seems unfair for you to single it out for penalty just because unlike the many other factors that can diminish someone’s performance behind the wheel — including staying out too late the night before or being distracted by some personal drama — sleep apnea happens to have a clinical name.You say you doubt that you could persuade your driver to get treatment. Trying seems a much better place to start than tattling.

Why not tell the driver when he shows up you will drive. Safety first . You can tell your solution as you drive them back. Plant the seed . Stomping the ground just stirrs up dust and makes your feet hurt. 
If you see a drunk driver you quickly call the police..or you should. The untreated future apnea patient is placing you and your family at risk. The person you save maybe your own child or mine.
I have no hesitation in contacting the company.

Hi D.W. , You being a respected sleep professional have credentials to back up what you suspect /know ......Even with your credibility the chances of you being taken seriously are small .

To think one of us would be taken seriously even smaller.  You and I know how deadly it is . Which is why I respect you and  know what you have to say is important.  I am for saving lives , education is the key .
